Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the e-Marketing platform at emarketing.com.ng (the “Service”), provided by e-Marketing (“we”, “us”). By creating an account or using the Service, you agree to these Terms.
1. Eligibility & account
You must be at least 18 and able to form a binding contract. You are responsible for the accuracy of your account information, for keeping your credentials (passwords, API keys, SMTP credentials) secure, and for all activity under your account.
2. The Service
e-Marketing lets you authenticate sending domains, send transactional and marketing email via API or SMTP relay, manage contacts and campaigns, and track delivery. We may update, improve, or modify features over time.
3. Acceptable use
Your use of the Service is subject to our Acceptable Use Policy. You must only send to recipients who have consented to receive your email, must honour unsubscribe requests, and must not send spam, unlawful, or harmful content. We may suspend sending to protect deliverability and our infrastructure, including automatic pausing of accounts that exceed bounce or complaint thresholds.
4. Plans, billing & credits
Paid plans are billed in advance through Paystack on a recurring (monthly or annual) basis, or as one-time Pay-As-You-Go credit purchases. Prices are shown in Naira (₦). Subscriptions renew automatically until cancelled; you may cancel at any time and retain access until the end of the current period. Except where required by law, fees are non-refundable. Plan limits (emails, domains, contacts) are enforced and may block further use until you upgrade or the period resets.
5. Your content & data
You retain ownership of the content and contact data you upload. You grant us a limited licence to host and process it solely to provide the Service. You represent that you have all necessary rights and consents for the data you upload and the email you send. Our handling of personal data is described in our Privacy Policy.
6. Third-party services
The Service relies on third parties including Amazon Web Services (Amazon SES) and Paystack. Your use may also be subject to their terms. We are not responsible for third-party outages outside our control.
7. Suspension & termination
We may suspend or terminate your access if you breach these Terms or the Acceptable Use Policy, fail to pay, or create risk to the Service or others. You may terminate by closing your account.
8. Disclaimers
The Service is provided “as is” and “as available”. We do not warrant uninterrupted or error-free operation, specific deliverability or inbox-placement rates, or particular results.
9. Limitation of liability
To the maximum extent permitted by law, we will not be liable for indirect, incidental, special, or consequential damages, or for loss of profits, data, or goodwill. Our total liability for any claim is limited to the amount you paid us in the 3 months preceding the claim.
10. Governing law
These Terms are governed by the laws of the Federal Republic of Nigeria, and disputes are subject to the jurisdiction of its courts.
