This Privacy Policy explains how e-Marketing (“we”, “us”, “our”), operating at emarketing.com.ng, collects, uses, discloses, and safeguards information when you use our email marketing and SMTP platform (the “Service”). We process personal data in accordance with the Nigeria Data Protection Act 2023 (NDPA) and other applicable laws.
1. Who is responsible for your data
For data about account holders (our customers), we act as the data controller. For data your account uploads about your own contacts (recipients of your campaigns), you are the data controller and we act as your data processor, processing that data only to provide the Service on your instructions.
2. Information we collect
Account data: your name, email address, organization, password (stored hashed), and authentication tokens. Billing data: plan, transactions, and references — card details are handled by our payment processor (Paystack) and are never stored by us. Sending data: domains, DNS verification status, API/SMTP credentials (stored hashed), templates, campaigns, and contact lists you upload. Delivery data:message metadata and events (delivered, opened, clicked, bounced, complained). Technical data: IP address, device/browser information, and log data.
3. How we use information
To provide, operate, secure, and improve the Service; to authenticate you and process payments; to send transactional and service emails; to deliver and track the emails you send; to maintain deliverability and prevent abuse (including bounce/complaint suppression and reputation monitoring); and to comply with legal obligations. Our lawful bases include performance of a contract, legitimate interests, consent (where required), and legal obligation.
4. Sharing and sub-processors
We share data with infrastructure and service providers that help us run the Service, including: Amazon Web Services (Amazon SES for email delivery and hosting), Paystack (payments), and our own hosting and database providers. These sub-processors are bound to protect data and process it only on our instructions. We do not sell your personal data.
5. International transfers
Some providers (e.g. Amazon SES) may process data outside Nigeria. Where data is transferred internationally, we rely on adequacy decisions or appropriate safeguards as required by the NDPA.
6. Data retention
We retain account and sending data for as long as your account is active and as needed to provide the Service, then for a reasonable period to comply with legal, tax, and accounting obligations. You may delete contacts and content at any time; deleting your account removes your data subject to retention required by law.
7. Security
We use encryption in transit (TLS), hashed credentials (argon2), access controls, and per-tenant isolation. No method of transmission or storage is completely secure, but we work to protect your information using industry-standard measures.
8. Your rights
Subject to applicable law, you may request access to, correction of, deletion of, or a copy of your personal data, and you may object to or restrict certain processing. Recipients of campaigns can unsubscribe via the link in every marketing email, and hard bounces/complaints are automatically suppressed. 9. Children
The Service is not directed to individuals under 18, and we do not knowingly collect their data.
10. Changes
We may update this Policy from time to time. Material changes will be notified through the Service or by email, and the “Last updated” date above will change.
